TERMS AND CONDITIONS

You should carefully read these terms and conditions and ensure that you agree to them before proceeding with the 3 Day FREE Optus Trial. By accepting the terms & conditions as part of the trial you are legally bound by this agreement.

1. NECESSARY AUTHORITY

1.1 If You enter into the 3 Day FREE Optus Trial, whether for Yourself or a company, You acknowledge and warrant to Try Wireless that:

1.1.1 You have the full authority to engage in the transactions You undertake;

1.1.2 You will be liable for all costs, fees, charges and other amounts which are due to Try Wireless for any Applicable Charges incurred outside of the 3 Day FREE Optus Trial as outlined in Clause 2.

1.1.4 All information You provide to Try Wireless via the Participating Optus Shop for the purpose of the 3 Day FREE Optus Trial is true and complete to the best of Your knowledge.

2. APPLICABLE CHARGES OUTSIDE OF THE 3 DAY FREE OPTUS TRIAL

2.1 You authorise Try Wireless to charge Your Credit Card the following Applicable Charges in the below instances:

2.1.1 A daily charge of $10.00 incl GST to the day prior to the receipt of the Wireless Modem Kit by the Participating Optus Shop if You return the Wireless Modem later than the agreed End Date, up to 7 days.

2.1.2 $200 if the Wireless Modem is:

2.1.2a  Not returned after 7 days following the End Date of the agreed 3 Day FREE Optus Trial period.

2.1.2b Returned faulty as a result of Your misuse.

2.1.3 A Data Excess charge of $0.12 for each megabyte of data upload and download over the 3 Day FREE Optus Trial combined data allowance of 450mb.

2.1.4 If the Wireless Modem Kit is returned minus any of its content or the content is damaged (except for the Wireless Modem which will be charged as per Clause 2.1.2 if not returned), You authorise Try Wireless to charge $20 to Your Credit Card.

3. AUTHORISATION OF CREDIT CARD PAYMENTS

3.1 You shall submit information from a Visa, Mastercard or American Express Credit Card and authorise Try Wireless to charge the Credit Card for all Applicable Charges Outside of the 3 Day FREE Optus Trial as per the terms of this agreement. All Charges are in Australian dollars (AUD).

3.2 Try Wireless will authorise the Credit Card provided by You at the time of entering the 3 Day FREE Optus Trial and You authorise Try Wireless to capture all relevant Charges as listed in Section 2 above on Your Credit Card if and when applicable.

4. GENERAL TERMS

4.1 It is Your responsibility to return the Wireless Modem Kit to the Participating Optus Store where the 3 Day FREE Optus Trial was initiated by the End Date of the trial.

4.2 It is Your responsibility to use the Wireless Modem in a proper and careful manner in accordance with the instructions and manufacturer's specifications and in no other manner.

4.3 You agree that You will not conduct any repairs, modify, deface, or remove any stickers and markings attached the Wireless Modem. By conducting any of the before mentioned changes to the Wireless Modem will deem the Wireless Modem faulty and You will be charged in accordance with Clause 2.1.2.

4.4 Wireless Modem usage is limited to Australia only. The modem is not equipped or permitted for use outside of Australia.

5. PRIVACY

5.1 Try Wireless will comply with Our Privacy Policy and the Privacy Act 1988 in relation to any personal information about any natural person You provide to Try Wireless.

5.2 Without limitation, You consent to Try Wireless collecting personal information about You for the purpose of Try Wireless fulfilling the 3 Day Optus Trial under this Agreement.

5.3 You authorise Try Wireless to make any inquiries reasonably required to satisfy itself of Your identity, eligibility to participate in the 3 Day FREE Optus Trial or any other matter Try Wireless reasonably considers to be necessary.
